1. Definitions and applicability
1.1. In these terms and conditions, the terms below have the meaning indicated:
- Order: an order for a Product by a Customer;
- Customer: a natural person who visits the Web Shop or places or wishes to place an Order, not acting in the scope of trading, commercial or professional activities;
- Agreement: the purchase agreement of a Product by the Customer via the Web Shop;
- Product/Products: the product(s) that Susy Cyclewear offers for sale in the Web Shop;
- Web Shop: the web shop under the domain name susycyclewear.com
1.2. These terms and conditions apply to every use of the Web Shop, every offer of Susy cyclewear in the Web Shop, every purchase of Products via the Web Shop and all Agreements concluded and to be concluded between Susy cyclewear and the Customer and associated obligations.
2. Offers
2.1. Illustrations of the Products in the Web Shop are indicative. Colours on the Customer’s computer display may differ from the Product’s colours. Sizes specified in the Web Shop are also indicative.
2.2. All offers are without obligation; an Order only binds Susy cyclewear after Susy cyclewear has accepted the Order.
2.3. Obvious mistakes or errors in the offer of Products do not bind Susy cyclewear
3. The price
3.1. The price of the Products is the price specified in the Web Shop, unless an obvious error is involved.
3.2. In the event of obvious errors in prices, Susy cyclewear will inform the Customer who placed an order of this as soon as possible. The Customer will then have the possibility to confirm the Order at the corrected price or to cancel the Order. In the event that Susy cyclewear fails to contact the Customer, the amount paid by the Customer will be refunded.
3.3. Product prices include any applicable VAT within the EU only, but do not include shipping costs. The shipping costs will be added to the total amount. Please be aware that incase of extra import duties outside the EU, these need to be paid by the Customer.
3.4. Prices can be changed at any time. Except for what is stipulated in paragraph 2, this will not affect the Orders that Susy cyclewear has confirmed.
4. Establishment of the Agreement
4.1. An Order is placed by the Customer completing the order process in the Web Shop.
4.2. Subject to what is stipulated in paragraph 3, an Agreement is established once Susy cyclewear has electronically confirmed the receipt of an Order and the Customer has satisfied the conditions stipulated with the Order.
4.3. In the event that Susy cyclewear has valid reasons for not entering into the Agreement, it is entitled to refuse an Order or to stipulate special conditions for fulfilment.
5. Delivery
5.1. Subject to what is stipulated in Article 5, Susy cyclewear will offer the accepted Orders to the postal service as quickly as possible, but no later than within seven days after receipt of the payment, unless a different delivery term has been agreed upon. In the event that the delivery suffers delays or an Order cannot be fulfilled or can only be partially fulfilled, the Customer will be notified of this no later than seven days after he or she placed the Order. In that case, the Customer is entitled to dissolve the Agreement at no cost.
5.2. Following dissolution in accordance with the previous paragraph, Susy cyclewear will immediately refund the amount that the Customer paid.
6. Payment
6.1. The Customer makes the payment in accordance with the payment methods offered in the order procedure and in accordance with the conditions stipulated.
6.2. The Customer must immediately notify Susy Cyclewear of any inaccuracies in payment information that he or she has provided or specified.
6.3. In the event that the Customer fails to pay, any extrajudicial collection costs will be charged.
6.4 Susy cyclewear handles the following payment methods; Ideal, Mister Cash, Sofort banking, Meastro, Visa and Mastercard.
7. Retention of title
7.1. The title to Products only passes to the Customer after the purchase amount has been paid in full.
8. Right of withdrawal
8.1. During a reflection period of fourteen days (hereinafter: the “Reflection Period”), the Customer can dissolve the Agreement without giving any reasons (hereinafter: the “Right of Withdrawal”).
8.2. The Reflection Period commences on the day on which the Customer or a third party designated by the Customer received the Product. In the event that the Customer ordered several Products in the same Order, the Reflection Period commences on the day on which the Customer or the third party designated by the Customer received the last Product.
8.3. During the Reflection Period, the Customer will handle the Products, the packaging and the labels with care. The Customer will only unpack or use the Product to the extent required to determine the nature and characteristics of the Product. The starting point in this is that the Customer may only use and inspect the Product as is customary in a physical shop.
8.4. The Customer is liable for any decrease in value of the Product that results from any handling by the Customer in breach of the previous paragraph.
8.5. In the event that the Customer wishes to exercise his or her Right of Withdrawal, he or she informs Susy cyclewear of this within the Reflection Period by sending an email to [email protected]
8.6. The Customer returns the Product (including the labels) as quickly as possible, but in any event within the Reflection Period, to the following address: Susy Cyclewear, van dorth straat 34, 6921 AZ Duiven, The Netherlands
8.7. The Customer returns the Product together with all accessories delivered, in the original condition and packaging.
8.8. The Customer returns the Product as follows:
-The customer sends an email to info@susycyclewear within the reflection period.
- Please mention your order number and address in this email.
-The customer sends it back on their own cost to

-Please add a copy of the email with ordernumber and your address.
-The Customer returns the Product(s) with a tracking number.
-After the product is received, the price of the item will be returned to the customer
9. Privacy
By providing his or her (personal) data, the Customer agrees that Susy cyclewear may use these data to send a monthly Susy newsletter. The customers data info will not be given to any third parties.
10. Complaints
Incase of any complaints Susy cyclewear will try to solve these as soon as possible. The Customer can submit their complaints per e-mail to [email protected]. Complaints will be handled within five working days.
11. Other provisions
11.1. In the event that one of these terms and conditions is null or voidable, this will not influence the other terms and conditions.
11.2. Susy cyclewear is entitled to review and amend these general terms and conditions at any time.
12. Applicable law
All Agreements and these terms and conditions are governed exclusively by Dutch law.
